These Terms & Conditions ("Terms") govern your use of the Thazoryn Veyra service ("Service") provided by Carl Sheppard ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms.
1. The Service
Thazoryn Veyra is a voice-activated AI conversational platform featuring multiple AI personas ("beings"). The Service is provided on a subscription basis and as a limited free tier.
2. Eligibility & Account
You must be of legal age in your jurisdiction to use the Service. If you use it on behalf of an organisation, you confirm you have authority to bind that organisation. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
3. Acceptable Use
You must not misuse the Service. In particular, you agree not to:
- use the Service for any unlawful, fraudulent or abusive purpose;
- send spam, malware, or interfere with the security or integrity of the Service;
- probe, scan, scrape, or attempt to reverse engineer the Service;
- infringe the intellectual property or privacy rights of others;
- generate illegal content, hateful content, sexual content involving minors, content that incites violence, targeted harassment, or non-consensual deepfakes;
- use outputs to impersonate real people without consent or to defraud anyone;
- attempt to jailbreak, bypass safety filters, or extract system prompts.
4. AI Outputs & Accuracy
The Service uses generative AI. Outputs may be inaccurate, incomplete, biased, or offensive. You are responsible for your prompts and for how you use the outputs. Outputs are not a substitute for professional advice (medical, legal, financial, psychological or otherwise). You must independently verify any information before relying on it. You are responsible for ensuring you have the rights to any content you submit as input.
5. Intellectual Property
We retain all rights, title and interest in and to the Service, including the software, models, prompts, "beings", branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose within your subscription plan. You may not resell, redistribute, or sublicense the Service.
You retain rights in the content you submit. Subject to applicable law, you own the outputs generated for you, but you acknowledge that similar outputs may be generated for other users. If you believe content on the Service infringes your rights, contact us at trinovasoul@gmail.com with details; we will investigate and may remove content and terminate repeat infringers.
6. Payments, Subscriptions & Refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are governed by Paddle's Buyer Terms. See our Refund Policy for our refund window.
7. Service Availability
We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may modify, suspend or discontinue features at our discretion.
8. Suspension & Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for: (a) material breach of these Terms, (b) non-payment, (c) suspected fraud, abuse or security risk, or (d) repeated or serious policy violations. On termination, your right to use the Service ends immediately. You may request export or deletion of your data by contacting us.
9. Warranties & Liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death or personal injury caused by negligence).
10. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your content, your unlawful use of the Service, or your breach of these Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, save where local consumer law gives you rights to bring proceedings in your country of residence.
12. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
